Hello
I have made registered sale agreement with seller to purchase the house. Seller didn't show up for house registration having intention to cheat me, I have filed OS case. Now seller didn't pay his house loan and bank is going to auction the house. How can I act on it now.

A.Dear Sir,

You may incorporate the bankers also as party and thus you can get decree in your favor if you are ready to pay the arrears of loan of the bank.

A.Dear Client,

A home loan has to be closed before selling a property. In practice, the process works as follows: - First an NOC to sell is obtained from the bank or lender subject to loan foreclosure. - The buyer makes the payment to the bank for the foreclosure amount and the seller obtains the documents and the NOC from the bank - The balance payment is made by the buyer to the seller and the latter hands over the property papers to the buyer and registration and handover is done.
Thus, you may file a case against him.
