Hi

I had booked a Villa in 2018, on the basis of our requirements we had slight modification in our plan, according to the modification, we agreed to pay 61 lakhs. We paid an advance of 25lakhs, builder accepted to provide A flat in an apartment and agreed to pay Maintenance and Rent for the construction period of 15 months...The project got Delayed and in between we paid another 20lakhs through bank loan, as they forced to pay in Dec-2019, we paid 15 lakhs, and 5 lakhs by feb -2020, the above payment were given because the builder claimed they did the Outer & Inner plastering, we agreed we paid since 30th Jan-2020, no civil work took place, during Jan 2021, they called us for choosing the Flooring tiles & bathroom tiles we choose and we gave the laying was done in April-May-2021, we were not happy with the tiles laying, though, Till today the project is not completed 100% even though we went to the office to discuss about the handover and balance payment, during the discussion we had arguments which leads to exchange of abuse words, hand over is still awaited.

We still continuing to stay in the apartment flat, which the builder provided, in Feb-2019, actually, the flat belongs to the Joint Venture Owner, the JV owner sold the apartment in 2021 Dec.

Now we approached the builder, in discussion we had a big quarrel, so that now he is denying my handover... Where I am ready to pay the dues...The project is 90% completed we are ready take the possession, because of the fight between us and the builder due to the delay and certain additional work, the builder denying my registration, all the documents were signed as agreement but not registered.

What can be a solution to manage the possession.

A.Dear Sir,
You may threaten to go to Media and also consumer forum claiming huge compensation thus due to fear in respect of his reputation he may hand over the possession of the property to you.

A.Dear client,

You can approach a lawyer and send a legal notice to the builder. Then you can proceed with filing a case against him.

A.Dear Client
If the project is registered under the RERA then you can approach the RERA court to seek the relief and if not then you can first send a legal notice to the builder through a lawyer and then file a case in consumer forum against him.
