Divorce petition
I had applied for Divorce petition in 2018 and order of maintenance is from 2020 and I cleared one year maintenance and need to clear 2 years of maintenance which comes close to 4 lacs one of my counsel suggested to withdraw petition to avoid payment of maintenace I need to know pros and cons of it
A.Dear Client,
If divorce is applied for, then maintenance follows with it. On withdrawal of petition, yes, maintenance to be paid would cease. However, the parties to a divorce petition are not allowed to withdraw from such petition unless both parties are willing to withdraw their consent.
