Hello Sir,
One of my relatives is undergoing a weird turmoil. His wife initially complained about receiving less jewellary, insisted that his sister did not let her buy clothes she wanted(gift from groom side). She was also pressing her husband on not having enough savings for the future (when he already has a flat, and his parents have a house) she also insisted as she had left her job of a teacher (sal 15K) she wants s money 25K for herself and another 40 to save. Initially the parents tried to talk her why is she getting so stressed and everything is ok as the relative of mine is a govt servant class I . The girl slowly started abusing his parents (on phone) as she was already living with her husband. The relatives of mine started receiving distress call from son that she is beating him and harrasing him of saying i will file a domestic violence case get whole family arrested. The family was worried and hence they decided to visit them. While all this the husband to make her happy before his parents came also took for a trip so that she behaves well, however nothing changed. When she went to Goa she reported that she was pregnant (may be 2-3 weeks) and the husband said that she demanded alchol in Goa and when he said she was pregnant she insisted everyone drinks.Post return the parents where already here for a week and she said she has bleeding and has immence pain hence want to abort the child. The husband did not even consult his parents and they aborted the child as the doctors said there was no movement (status unclear as parents did not see any reports). The husband is mostly accomadting as the wife couple of time threated him of coming to his office and is a loose cannon. Post some time at present her parents went there and even then the boy called parents one night and was crying saying she has made his life miserable and there is no way for him. The girl has also been abusing husband in front of her parents including hitting him and parents seem to not intervine.

In the meantime the parents did not take any goods/cash from the girl side . The jewellary the girl received from both sides she took and deposited in her locker. The girl also have been taking money every month which keeps piling with amounting 4 lac so far. She is also pressing the boy to buy a plot, big car (stating he is class I). The boy is just succumbing to pressure and not retaliating as it may harm his reputaion. She also has a problem if he talks to his sisters, family and she wants the boys parents to not discuss it with anyone in her family.

A.Dear client, the husband has to file a complaint under sec 506 of ipc for criminal intimidation and harassing. He can also file a divorce under sec 13 of hindu marriage act on grounds of harassement and cruelty.

A.Dear Client, If the behavior of your spouse makes you upset and becomes a cause of mental harassment and cruelty, then you may file a divorce petition against your spouse under Sec.13 of the Hindu Marriage Act, 1955. before the family court or District Court. Mental cruelty as a ground for divorce was inserted after the Marriage Laws (Amendment) Act, 1976. It states that a decree of divorce can be obtained by either spouse if one spouse has treated the other with cruelty. Section 13 (1) (ia) of the Hindu Marriage Act, 1955, allows either spouse to seek divorce on the grounds of cruelty. Mental cruelty is a course of conduct on the part of one spouse that can endanger mental health and cause apprehension in the mind of the other spouse to such an extent as to be injurious for him or her to continue the marital relationship. The behavior of the other spouse must cause apprehension in the mind of the appellant. The appellant needs to prove that further continuance of the matrimonial relationship is harmful to the mental health along with physical health of the appellant. The party seeking divorce on the grounds of cruelty can submit audio, video or written evidence to prove his or her claim. If there is no possibility of cohabitation and no scope of mutual divorce, you can file a one-sided/contested divorce petition before the District Court/Family Court praying for a decree of divorce. However, grounds for one-sided divorce reflect the various challenges and complexities that may arise in the course of divorce proceedings. It is always recommended to consult an expert divorce lawyer to get the right legal advice before filing a contested divorce petition.
