Hi - I was married in India in 2016 and have been living in US from more than 5 years now. I am going through the divorce process filed in the US. My laws and my ex husband are giving me hard time in giving back the gold given to me by my parents and other relatives during marriage. All the gold currently resides with my ex mother in law in Rajasthan. What is the best way to do a legal action against them?

If your in-laws refuse to return the jewelry gifted to you at the time of marriage (Streedhan), filing a police complaint under Section 406 of the Indian Penal Code is a viable option. You need to file the case in India, where your in-laws reside, providing bills for the jewelry and details of the bank account where the jewelry is kept. If you're abroad, you can execute a Power of Attorney in favor of someone to handle the case on your behalf in court.

The jewelry gifted by your parents/relatives at the time of marriage is your Streedhan. In case your husband's family refuses to return the Streedhan, filing a police complaint under Section 406 of the Indian Penal Code is a viable option to get back your Streedhan from your inlaws. So, you need to file a case in India where your inlaws are staying for recovery of your streedhan. You must provide bills of that jewelry and details of the bank account where your inlaws put your jewelry. Staying abroad, you may execute a Power of Attorney in favour of any person of your choice to handle the case on your behalf before the Court to obtain a favorable order in the matter. You can opt for a virtual consultation or video conferencing with an Advocate of the concerned state/district of India for guidance and steps in the matter
