LAND SOLD OUT WITHOUT PERMISSION

I bought land in Siliguri, West Bengal before 9 years from my cousin brother and last year by September I got to know that he sold out my land. I have payment receipt of that land. My query is I can file case against them in Delhi Court as I live in Delhi with my family and due to my chicken's school I can't travel frequently to Siliguri.

Your disputed property is in silliguri and defendant is also residing in silliguri as per Cpc and Sra act if you have agreement of sale and payment receipts you can file suit. And you can also pray for cancellation of sale along with file a police complaint against seller and buyer, he may be involved in this fraud also.police will whether he is bona-fide purchaser it not

A.If payment received made in Delhi then you can file Suit against your cousin brother under section 420 & 406 & also money suit because place of occurrence about selling purchasing is Delhi for more information you make contact with me through my mobile and email id also

A.No Maam,
You cannot file the case in Delhi. The jurisdiction to file a case related to an immovable property lies with in the local area where the property is situated. So you will have to file a case in the local civil court.
