My Brother Wife went her mother house and not ready to come back . How can we move legally.This is not first time she is repating since 3 years.

A.1. Send her a legal notice to come back, failure of which shall lead to filing of RCR
2. File a RCR petition stating that she has left without reasons.

If she does not come back, then the court shall proceed exparte.

A.If you wants to get her back amicable settle the matter with your wife, or send legal Notice to return her back within 15 days time . If she denied for then file Restitution of Conjugal Right before the family Court, else contact me

A.Dear client,
If you want to move legally then first let her be served a legal notice describing events and nature, attitude etc. To come back. If denies then Opt to file a petition for Restitution of Conjugal rights, at Family Court
