if owner died without appointing a nominee then legal heir has legal right to claim that money. You need to show bank that you are a son of your late father and they will have to give you your share as it is your right.

A nominee is just a care taker of that money, he has no right to use that money for personal benefit. The legal heir i.e. you and your mother has full right over that money of your father and you can take that money back from your uncle either by consulting with him or in case he denied to give back money you can serve him with a legal notice.
