Its an absurd clause that if you do not stay then what can be done. It is not about staying but about paying the rent for six months. If i take a house on rent and keep paying the rent then regardless of staying or not it is a valid agreement. The landlord seems to seek excuse for not returning the money.
During COVID everyone has been so cooperative and understanding, it is expected the same from him.

If a property is in the name of a person then invariably that person's consent is required to alienate ( sell/transfer) the property and it is mandatory requirement. Without his consent it will be difficult to proceed ahead. What you can do is get the partition done for the land and then proceed with the selling.

As per the agreement the tenant should be vacating the shop once the tenancy is over or when you serve him a notice of terminating the agreement. If he does not then you can file a case for eviction of the tenant.
Alternatively you can ask him to pay 40,000 from next time onwards and let him continue there.
