I am legally married but not socially married yet. In this corona we begin to live together. We get married out of love. But my groom drinks alcohol every night, beats me, abuses me, physically abuses me, keep me locked in the house and doesn't want me to come to my parents. I can come to my parents holding hands and feet a lot but then when I meet my groom the beating starts, they don't even let me stay with my parents and doesn't even talk on the phone. I thought it would be okay to come but it is growing more and more. Plz give me some advice. And I gave her a lot of money, will I get it if I get divorced? My groom doesn't want to divorce me but kills me like an animal. Plz somebody help me

A.In law there is no concept of any social marriage. Once you are legally married then that is sufficient for all purposes. You have married a person and marriage is an institution based on mutual basis so your husband in any eventuality can not treat you as slave. Assert your right and does necessity arise report the matter to police. For divorce minimum one year is to be expired for filing divorce petition, however, you can apply for annulment of marriage. You can claim your istridhan etc.

A.Shilpa, since you are legally married, therefore,if you want to terminate the matrimonial knot, then,
try to settle the matter amicably with your husband involving elders/relatives/friends etc and go for Mutual Consent Divorce which will be decided in 6-18 months, and you both will be free to live life with your wish,
(a separation of one year is mandatory before filing the MCD)
don't forget to draft an MOU before approaching Mutual Divorce, which is the most essential and important part of a Divorce case,

some basic points to keep in mind and put in writing through an MOU before filing the petition for mutual consent divorce are custody of kids, distribution of assets (movable/immovable), quash/withdraw of pending litigation if any, Maintenance (present/future), Alimony, mode and time of making the payment, streedhan, future litigation, etc.

if failed, you are advised to file/claim
498a complaint (for causing mental, emotional, physical and monetary abuse, etc)
Domestic Violence case (for causing mental, emotional, physical and monetary abuse, etc)
you have rights to claim residence, protection, compensation, maintenance,

A.Dear client,
You can immediately file an FIR against your husband regarding domestic violence and should go to your parents house with the help of police.
You should further file a contested divorce against your husband.
No women should be beaten up or I'll treated jist for marrying and taking care of the household of her husband. YOU HAVE TO TAKE BOLD STEPS. Your life is in your hands.
