1. What should be done if the husband is deliberately delaying the process of mutual divorce for months?
2. Can mutual divorce filing be done without the presence of both the spouses, with just their signatures?

A.You can very well serve a legal notice to your spouse, mentioning all the details of undertakings and terms of settlement with him. Sum up / conclude your legal notice with a stern warning to initiate punitive legal course against him. Wait for his reply as per time in notice. Then take advised legal action.

A.Hi,
If your husband is delaying the process of mutual divorce, you can yourself initiate divorce proceedings by filing a divorce petition in court.

Nothing much could be done in such cases, but instead, you can file a divorce petition yourself on the grounds of divorce.

A.No, the filing of Mutual Consent Divorce petition can not be done without the presence of both the parties. If the husband is deliberately delaying the filing then try to find out that whether he really wants to co-operate in filing or not. He you finally find that he is not willing than you may proceed for normal Divorce on merits from your side.
