Will court consider wife's parents farming loan and her brother's education loan as her liability and its emi as her salary deductions while calculating interim maintenance?

A.Hi,
It is a question of her reasonable needs given the standard of living during the marriage and her ability to meet those needs independently from earnings and/or income from property being awarded to them in the dissolution of the marriage. These factors are generally taken into account for calculation of maintenance amount. However, there is no hard and fast rule regarding the same.

Generally, the maintenance amount is calculated by taking into account the total monthly home income
of both the spouses. The educational background of the spouses, the number of years of marriage, number of children and child custody are also major factors, which govern the maintenance amount.
