I am a working mother, with a 9 years old son. My husband is jobless for the past 4 years and never contributes a penny towards the family expenses. I take care of all his expenses. Can I file a case against him seeking maintenance towards the family expenses? I live in Dubai and he lives with me too. Can I file a maintenance case in india while we are living together in Dubai?

A.You can not file the maintenance case in Dubai if you are staying with him in Dubai. Either you come to India and file the maintenance case from here or file in Dubai itself. Frankly speaking, it would be better to have the complete details about the facts of your case than only it will be possible for any advocate to give the proper advice.

A.India court don't have jurisdiction over UAE.
You can approach UAE Court for maintenance.
If you need divorce then file divorce petition.

As per your inputs you are a working women, then you have no ground to file a maintenance petition. Motivate him to go for work and earn, else arrange family counselling through video call. so that he would change his attitude and starts earning

A.Hi,
According to Section 125 CrPC you can file a petition for maintenance against your husband in the Indian court. However, it is unlikely to get an order in your favor as your husband does not have sufficient means to support you or your child.
