Hi all,
I have recently come across a plot which has got DC conversion and also has BMRDA approval (NPA). However when I was verifying the land records I found few defects in the Mutation Records which was executed before the DC conversion. I have tried to explain here in simple terms, here it goes
• Party 'A' has sold the property agricultural land to Party 'B' in 4 chunks n1,n2,n3 & n4 guntas i.e., four different Schedules for the same survey no. measuring extent n1, n2, n3 & n4 guntas respectively.
• All 4 schedules have been recorded in sub registrar
• However in the Mutation only 2 chunks/schedules are accepted i.e., n1 & n2 guntas and the other two i.e., n3 & n4 guntas were rejected stating the reason as "Sign miss match on the 11E sketch".
• Despite of this Party "B" has got the DC conversion to the extent of all the 4 schedules i.e., n1+n2+n3+n4.
• Later Party "B" has made a joint development agreement with a builder Party "C".
• Now Party "C" has made the development with proper plan approved from NPA for the whole extent.
• HDFC bank also has the approval for this project.
Now when I ask the builder Party “C” regarding the rejected Mutations, they are telling that since now the land is DC converted there won’t be any issue in future, even if there are any legal issues then they will only resolve. But as am I aware it is a must to have the Mutation in the name of purchaser (in this case Party “B”) for Agricultural land.
Please suggest me whether I can buy a plot from the builder or not? Will there not be any legal issues in future since two of the Mutations were rejected before the DC conversion?

A.Dear Sir,
The issues may raise after your purchase any time better to avoid purchasing such properties which are not having clear title and clear mutations.
