Maintenance amount required

Please let me know the maintenance amount. We have one year of married life and 15days baby boy. My wife intentionally staying her mother house. My income is 25k and her 15k. We both have master degree. We are both working in same office. Her mother asking maintenance from me.

A.This is not a legal query. Your mother in law has asked you to pay for the daily expenses of your wife and your child in such sensitive condition where your wife will not be able to work for few months and baby needs utter care and your wife will need some female attendant to be around if needed so there's nothing wrong if your wife is staying at her mother's place for month or two in such condition. You should be paying on your own instead as much possible from your end towards maintenance of your wife and child for their betterment at least till your wife returns to her job and in case you are not sure of the amount than you can directly talk to your wife to fix the same by making list with mutual understanding and considering the needs and your earnings.

Usually, when the court decides on the maintenance amount, it is calculated as somewhere between one-fifth to one-third of the monthly salary. However, since you are both earning somewhere around the same amount, you can claim that your wife does not need require maintenance and that you will anyway be taking care of your son. And that you will pay for her necessary expenses as well.

usually a maintenance between 25 to 50% of the earning can be given to the spouse as per the order but since she is working hence you will need to pay less. But yes you will be required to pay the separate maintenance for your child.
