We are married for two years. My wife now claims Im Impotent. and We never had sex. Actually she has a problem in conceiving to cover up she is doing all these false allegations. She demands lump sum maintenance, but i dont have any amount other than salary. I also dont want to stay with her after this incident. I want to take divorce with less maintenance. What should I do? How much percentage of my salary will go towards maintenance?

A.Dear Client,
Not more than 25% of your salary can be directed towards the maintenance of your wife as per the order of the supreme court. But it will be advisable to go for Divorce by Mutual Consent and give one-time lumpsome alimony.

A.Dear Client
What she is claiming is a good ground for contested divorce and not for MCD. IN MCD both the parties have to agree mutually without any allegations to go ahead for dissolution of marriage. if she is asking for MCD then tell her not to allege impotency.
As far as maintenance is concerned you will have to pay certain portion of your earning as decided by the court and not as per the wish of the wife.

A.You are suggested to go for mutual consent divorce by filing petition in the Family Court of your jurisdictional area by providing her a lumpsum amount and finish this issue without allowing her to levy any allegations against you and vice-versa and get rid of her and move ahead. Thank you.
