A.Dear Sir,
That ground itself give a cause of action for you to seek divorce without alimony. Get such ground confirmed through various modes from your wife like email, SMS, WhatsApp, Audio and even in writing on a stamp paper.

A.If you want to resettle with your wife in your own house along with your parents then kindly file a suit for restitution of conjugal rights in the district court of your jurisdiction through an advocate otherwise if you don't want to further stay together then you should file a divorce suit against your wife in the district court or else if both you and your wife wants to get mutual divorce then also you both may file a mutual divorce petition with the help of advocate in the district court. Hence you must consult with an advocate at earliest.

A.Dear Client,

As per the facts which have been provided, you should file a case of Restitution of Conjugal Rights in the Court by which the court will order her to return to you with the child. There will be counselling sessions in the court to advise you both to amicably settle the disputes between you.

Hope this clarifies your query and requirement.

Thank you.

If she is not coming back to the matrimonial house then you can file case of restitution of conjugal rights in the district or family court and get an order in your favour asking her to return to you r home.
