My husband is trying to send me divorce notice while I am at my mom's place with the intention that once I get the notice inhave to stay in my mom's place itself and cannot get back to my inlaws place. We live in a joint family with in laws. I have been married for 10 years now and with 2 kids 8years and 3 years. He is having affair and he hit me and my inlaws have asked me to go to my mothers place. Now I want to come back home and he is trying to send me divorce notice. My inlaws have locked the house and have gone to native so that i can't get into the house. What should I do. I don't want to be in my mom's place and want to get back to my house.

A.Dear Client,

A wife has the legal right to stay in the matrimonial home under any circumstances i.e even after her spouse dies. If there’s a case of divorce, the woman may choose to live in her matrimonial home until there is a proper place for her to move in. she can legally stay in that home if she wants to.
Your husband cannot give you a divorce without mutual consent.

Thank you, so even if i receive the divorce notice that my husband sends while i am at my moms place i can still go back to my in-laws place right. My in-laws have also issued notice stating me not to enter their house. Please advise

A.Dear Sir,
You may break open the locks put up by your laws and stay in your matrimonial house without any issue since you are the owner of that house.
