Demolished Outer Stairs By Builder for The Name of New Water Supply Work.
Hello Sir,
I have purchased a plot in colony and builder selling residentials plots which is approved by RERA - MP in 2018. They demolished our outer stairs and saying that you occupied illegal land and your stairs construction is illegal's because your stairs is in our land. We have a corner plot and two sides having 3 feet open space then having 1.5 feet naali for water drainage and after that having colony service road.
I just want to know that, Is the colonizer having any rights to demolished any work i.e outer stairs, 8 inch heighted small boundary to plan a small tree plantation which is under construction on the land of 3 feet between the our plot boundary and water drainage naali.
I request you to, please help us and provide any legal advice so that we can claim the repairing and file a case against the coloniser for mental harassment.
You can file criminal trespass case against him and also file Civil case claiming reconstruction of such steps and also claim huge compensation.
if the stairs are in the plot plan, then he cannot demolish the stairs without informing you and even without informing demolishing shows no right. right has nothing to do with the demolishing them.
Its not about the right of the builder to demolish the staircase but it is more about your building the stairs within the area provided to you and as per the sanctioned plan. If the stairs were within the plot sold to you then you have a case against him.
