Intercaste divorce
One of my friends did an intercaste marriage in December 2022 by performing Hindu rituals in front of the entire family (both sides have done video recording). They never opted for court marriage, and only one part wants to live their lives separately. In this case, will Indian law or the legal system like the Special Marriage Act or the Hindu Marriage Act apply to both parties?
A.Dear Sir,
You have to go with Divorce only under the provisions of Hindu Marriage Act since it is not registered under the provisions of Special Marriage Act.

A.Dear Client,
If both parties are Hindus, and they have solemnized their marriage with Hindu rituals in front of their families, this marriage can be considered valid under the Hindu Marriage Act. However, if one of the parties wants to live separately, they may need to go through a legal separation or divorce process as per the provisions of this act.
