A friend wants to divorce on grounds of disrespect and dishonesty by spouse. How long does it take if she contest alone and what is the time for mutual consent? If a petiton was already moved 5 years back for divorce but didnt follow-up as the couple went abroad, didnt reconcile and apply afresh, is there any lesser time it takes now? What happens if the notice is not received and rejected by the spouse and family?

A.Hi,
Divorce by Mutual Consent or Mutual Divorce is when both husband and wife mutually agree that they cannot live together anymore.
They would present a Mutual Divorce petition jointly before the honorable court, without putting forth any allegations against each other.

A.Hi,
STEP 1: First Motion involves joint filing of divorce petition. STEP 2: Husband & wife appear before court to record statements after filing of petition. STEP 3: Court examines petition, documents, tries reconciliation, records statements. STEP 4: Court passes order on First Motion.
The time period will depend upon the facts of the each case.

A.1) If she contesting alone Exparty decree will pass ( even responded not ready to accept notice same will be happen)
2) Mutual divorce petition period is 6 months from the date application.
3) If Petitioner not followup the petition, petition shall be dismissed by the court on default of appearance.

A.Dear client,
You can go ahead for contesting your divorce u/s 13 HMA . Also the time taken under mutual contest divorce will be two motions with the gap of 6 months in between.
