I got divorced in the Month of May 2022, though mutual consent. I am still yet to receive the court order. My son is living with me, and my daughter is livng with my ex-wife. I agreed to pay Rs. 5000 as monthly maintenance. Now, my ex-wife is demanding more money than agreed at the time of divorce and is threatening to file for maintenance case. it is possible to file such a case?

A.Dear Client
A wife can file a case for maintenance even after the divorce or mutual divorce. There you have to take the stand that since the maintenance was already agreed between the parties hence there is no need to move the court and case can be dismissed. You can show the agreement (MOU) that both of you executed.

A.Dear Client,
your wife cannot claim maintenance after mutual divorce if she voluntarily surrendered her part of right of maintenance but she can ask for alimony for your daughter.
