A. See as you are trying to be fair with the candidate by making him and yourself too liable to pay a penalty in case of non-joining the the candidate. This seems to be fair to me and I would say yes that it should be added to safeguard both parties interest.

A. Hi,
That may not affect your job unless your job agreement mandates it. In case there is an express prohibition of such candidates, it may lead to a problem. However, you can raise objections in case of any such actions. Please contact a lawyer for further advice.

1) You need to check the employment letter/internship letter for the terms and conditions regarding the stipend during internships.
2) If no salary was mentioned, then you are not entitled to get the benefits.
3) If a stipend was promised, then you can send a legal notice to the company and claim your salary.

A. He will have to reply parawise to each allegations in the chargesheet and then appear in front of the disciplinary committee to put forward his case and defend himself. There might be some oral questions asked to him for which he needs to reply appropriately.
In case the committee rules against him then he will have the option to appeal to higher authorities and then to the Labour Commissioner.

A. Hello Sir
It's the company's obligation to act according to the employment agreement agreed between you and the company. In case they doesn't pay you the full payment then you have an option to send the company a legal notice with the help of a lawyer to make the company act according to employment agreement. And if the deny to do so then you have all rights to proceed with initiating legal action against the company.
